OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: a) Throughout the warehouse and production floors: On or about May 10, 2013 and at times prior thereto, the employer exposed employees to struck-by hazards in that employees were allowed to operate powered industrial trucks without being provided with and required to wear seatbelts.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings: a) System 4 elevated platform; On or about May 10, 2013 and at times prior thereto, the employer exposed employees to 12' fall hazards in that employees were allowed to walk/work within 3' of an open-sided floor that was not guarded by a standard railing or other means of fall protection.
