29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) Grinding Dept., Premix 7. On or about July 2, 2013, an employee operating Hyster F310 electric forklift was exposed to struck-by and crushed-under hazards when handling a PY5002 supersack weighing about 1000 lbs. with forks inverted against the forklift manufacturer's specifications for safe operation. There is no abatement certification or documentation required for this item.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: (a) Grinding Dept., Filling Dept., Warehouse Dept. On or about July 2, 2013, employees operating electric and propane-gas powered forklifts were exposed to struck-by hazards when handling different loads of materials, where a refresher training including operators' performance evaluations was not conducted as specified in the standard at least once every three years. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
