OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing hazards as employees were operating a powered industrial truck that did not have seatbelts installed. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to install a seatbelt on the forklift and keep forklift operators from operating powered industrial trucks without using seatbelts.
