29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met.      a.) Humprhey Charcoal - On or about July 2, 2013, employees worked with and around hazardous substances including, but not limited to, charcoal dust, lime, oils and greases.  The company had not developed and implemented a Hazard Communication Program.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area.    a.) Humprhey Charcoal - On or about July 2, 2013, employees worked with and around hazardous substances including, but not limited to charcoal dust, lime, oils and greases.  The company had not provided employees with Hazard Communication Training.    ABATEMENT NOTE:    Employee training shall include at least:    1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.)    2. The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area    3. The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used    4. The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information

Throughout Facility - Accumulations of charcoal dust covered the entire indoor and outdoor portions of the Humphrey Charcoal facility.  No attempts to clean or curb the accumulation were made.

Humphrey Charcoal - throughout the facility employees were exposed to excessive amounts of charcoal dust in the air that settled on and covered the workers.  Excessive amounts of charcoal dust had accumulated on all equipment and building surfaces as well as all walkways.
