OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:        A.)  Humphrey Charcoal, Inc. - On or about 7/2/13, employees were exposed to crush hazards and impact hazards from powered industrial trucks that were not equipped with proper safety equipment/operator restraint systems.  Forklift (Yale; Serial #A809NO6107V) was not equipeed with an operator restraint system (i.e. - seat belt).  Employees operated the forklift for activities that included but were not limited to, loading/unloading trucks.

29 CFR 1910.23(e)(1): Standard railing(s) did not consist of top rail, intermediate rail and/or posts and/or did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level:             A.)  Humphrey Charcoal Inc.; weight baggger area - On or about 7/2/13, a platform connected to the weight bagger did not have a mid rail.  The fall from the platform to the ground was approximately 6 feet.     B.)  Humphrey Charcoal Inc.; lump baghouse - On or about 10/30/13, a platform utilized to access the dust collector did not have a mid rail.  The fall from the platform to the ground below was approximately 15 feet.     C.)  Humphrey Charcoal Inc.; briquette baghouse - On or about 10/30/13m a platform utilized to access the dust collector did not have a mid rail.  The fall from the platform to the ground below was approximately 20 feet.

Humphrey Charcoal, Inc. - On or about 7/2/13, the company had not developed, documented and/or implemented a lockout/tagout program consisting of machine specific procedures, periodic inspections, lockout/tagout hardware, authorized employee training and affected employee training.  The employees worked on machinery including, but not limted to, the  briquette oven, the mixer, the granulator, conveyors, and the briquette maker.

The work rest had not been adjusted as the wheel was worn.
