29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a)Location - Fabrication Shop: On or about July 8, 2013, an employee who was working in the fabrication shop was exposed to noise levels at 155.4% of the allowable 8 hour time weighted average sound level (90 dBA). The equivalent level of the 155.4% is approximately 93.2 dBA which is capable of causing permanent hearing loss. The sampling was performed for 358 minutes during one work shift on July 8, 2013. The noise level exceeded a dose of 50% and no hearing conservation program was in place at the time of the exposure.

Baseline audiograms had not been established for most of the employees in the fabrication shop at the time of the exposure.
