OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm including, but not limited to severe burns to employees in that employees worked in close proximity to enclosureless dust collection systems that were used to collect wood chips and dust that presented explosion, deflagration, and other fire hazards: a. 5 Tracy Lane - On or about June 13, 2022, employees were exposed to fire hazards from the Dust Technology enclosureless dust collectors (Model No. DTHHF-1500, Serial No. 1808-3485 and Serial No. 1901-3515) which contained explosive wood dust.

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment: a. 5 Tracy Lane - Sufficient access to the electric disconnect for the Vista (Model M-20AS; Serial No. 7222) was blocked by a wooden table and a piece of plywood on the floor. b. 5 Tracy Lane - Sufficient access to the two electric disconnects labeled PP1 26, 28, 30 for the panel jig hoists was not maintained.
