Those incidences occurred 1/15/13, 2/13/13 and 3/5/13.

(a) Phoenix Indian Medical Center (PIMC): PIMC did not remove the employee's name from the 2013 OSHA 300 log when a cut was sustained from a contaminated scapel. The incident occured 8/2/2013. Note: Per 29 CFR 1904.29(b)(7)(v): Needlestick injuries and cuts from sharp objects that are contaminated with another person's blood or other potentially infectious material must be considered to be privacy cases.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan: (a) Phoenix Indian Medical Center (PIMC): PIMC did not solicit input from non-managerial employees in areas such as the Emergency Department, Pediatrics and Nuclear Medicine to adequately identify, evaluate and select effective engineering and work practice controls. In addition, the means and method of solicitation from non-managerial employees was not documented in the Exposure Control Plan.
