OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. (a) North side, new residential construction located at 1717 Whitfield Circle, Smyrna, GA 30080: Employees exposed to being struck-by a falling load of trusses in that the slip hook was not securely attached to the SkyJack (Model VR-642D) Telehandler Forklift back rest.

29 CFR 1926.251(b)(3): Job or shop hooks and links, or makeshift fasteners, formed from bolts, rods, etc., or other such attachments, were used in the rigging equipment. (a) North side, new residential construction located at 1717 Whitfield Circle, Smyrna, GA 30080: Employee exposed to being struck-by a falling load of trusses in that the rigging equipment used had makeshift bolt and nut attached to the grab hook on the chain sling which was not provided by the manufacturer. Any modifications of any fitting is cause for removal from service as the working load limit is no longer valid.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Second floor top plate, new residential construction located at 1717 Whitfield Circle, Smyrna, GA 30080: Employee was exposed to falls while receiving roof trusses on the top plate at heights of approximately 20-feet, 1-inch with no fall protection system in place.
