29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 7/09/13, in the "Bullpen Area" on the fourth floor of the Larkin Center of Commerce Building, 701 Seneca St.,Buffalo, NY: A Dayton 30 in. Circulator Fan, Model 6C539 was used to provide ventilation. The Fan was connected to 120-volt ac power via a series of extension cords. The plug on the cord of this Fan lacked a grounding prong. Employees walk by this fan daily. b) On or about 7/09/13, in the "Bathroom Area" on the fourth floor of the Larkin Center of Commerce Building, 701 Seneca St.,Buffalo, NY: A Leading Edge Fan, Model LPM3025 was used to provide ventilation. The Fan was connected to 120-volt ac power via a series of extension cords. The last extension cord in the series was a coiled yellow "2-wire cord" that did not contain a grounding conductor. Employees walk by this fan daily. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.405(j)(3)(ii): A means was not provided to disconnect each appliance: a) On or about 7/09/13, in the "Bullpen Area" on the fourth floor of the Larkin Center of Commerce Building, 701 Seneca St.,Buffalo, NY: A Dayton 30 in. Circulator Fan, Model 6C539 had a "pull chain disconnect switch" which was broken and would not shut off the fan when pulled. Employees disconnected the fan by unplugging it. NO ABATEMENT CERTIFICATION REQUIRED
