29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a). On or about 8 July 2013, an employee was allowed to operate a Crown Pro S200 Series (Serial # 1A334701) reach truck while the braking system was not functioning properly, exposing the employee to an ejection, struck-by, and crush-by hazards.
