29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. At the worksite located at 600 West Goodale St. in Columbus, Ohio the employer had an employee on the fifth floor balcony of unit 550, approximately 45 feet in the air with no form of conventional fall protection.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows: a. At the worksite located at 600 West Goodale Street in Columbus, Ohio the employer had employees using fall arrest systems consisting of a full-body harness, rope-grab, and vertical lifeline. The vertical lifelines in unit 550 were wrapped around the studs of an interior wall and the employer was not able to provide engineered documentation that the wall, which was used as an anchorage for the fall arrest system was capable of withstanding the required force of a fall arrest. b. At the worksite located at 600 West Goodale Street in Columbus, Ohio the employer had an employee using fall arrest system consisting of a full-body harness, rope-grab, and vertical lifeline.
