29 CFR 1910.95(k)(3): The employer did not ensure that each employee exposed  to noise at or above  an 8-hour time weighted average of 85 decibels was trained and informed of the information included in sections k(3)(i) through k(3)(iii).  a)  Pallet grain operator:  On July 15, 2013 and at times prior; the employer exposed the employee to noise at levels of 262.4% (equivalent to an 8 hour time weighted average TWA of 96.9 dBA) which is 2.62 times the permissible exposure limit of 100 % (equivalent to an 8 hour TWA of 90 dBA) while working in the facility.  Annual training on the effects of noise, purpose of hearing protection and audiometric testing was not provided to the employee.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.  a)  Deep tank area:  On or about July 15, 2013 and at times prior; employees working next to a deep tank containing corrosive chemical are not provided with an functional eye and body wash station.   b)  Cut Stack area:  On or about July 15, 2013 and at times prior; employees using machinery that spray a corrosive chemical are not provided with an functional eye and body wash station.

29 CFR 1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.   a)  On or about July 15, 2013 and at times prior; the employer exposed employees to chemical hazards in that employees were allowed to handle chemicals without being trained on the methods that may be used to protect them from health and safety hazards.
