OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing hazards as an employee was operating a powered industrial truck in a warehouse and was not wearing a seat belt. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to keep forklift operators from operating powered industrial trucks without using seatbelts. Warehouse 1, loading dock, Goya Foods, 5 Goya Drive, Webster, Massachusetts; Employee operating forklift 902 was unloading and loading trucks while not wearing his seatbelt.

Instance a: Flex cord by the compactor in warehouse 3 spliced from black cord to orange extension cord, insulated with black electrical tape. Instance b: Flex cord on buffer in electrical room had multiple splices using black electrical tape as insulation.
