29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides,    a) oven cleaning area by loading dock,     Employees were exposed to fall hazards greater than 4ft when standing on the loading dock platform to clean oven racks. Condition noted on or about 07/23/13.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.36(d)(1): Employees must be able to open an exit route door from the inside at all times without keys, tools, or special knowledge. A device such as a panic bar that locks only from the outside is permitted on exit discharge doors.  a) In work area,   Employer did not ensure that emergency exit door leading to Alabama Ave was unlocked.  Emergency exit door had three sliding locks in the locked potion.  Condition noted on or about 07/23/13. 29 CFR 1910.138(a): Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes.    a)      Oven cleaning area by loading dock,      The employer provided nitrile gloves instead of neoprene gloves to employees who are exposed to chemical burns when using Oven Brite Cleaner and which according to the material safety data sheet causes skin burns and requires the usage of neoprene gloves. An employee sustained chemical burns on 04/18/12.  Condition was noted on or about 07/23/13.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.13.

Electric equipment shall be installed in a neat and workmanlike manner.    a)      Oven cleaning area by loading dock,     Thermostat 64 inches from the ground was missing a faceplate exposing employees to live wires. FLUKE volt tester to show that the insulated exposed wires were live. Condition noted on 07/23/13.
