29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103)(a) (a) At the inspection site located at 4001 South Lamar in Austin, Texas, on or about July 19, 2013 and at times prior thereto, the employer did not evaluate respiratory hazards in the workplace, including a reasonable estimate of employee exposures to respirable silica, where employees were using powered masonry saws for cutting penetrations in concrete masonry unit (CMU) blocks and knocking out cutouts. (b) At the inspection site located at 4001 South Lamar in Austin, Texas, on July 19, 2013 and at times prior thereto, the employer did not evaluate respiratory hazards in the workplace, including a reasonable estimate of employee exposures to carbon monoxide, where employees were using propane-powered floor grinding machines for grinding the concrete sales floor.
