29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  On or about December 28 2016, and at times prior thereto, a job made mud box  and a pallet were supported by two separate rough terrain forklifts and were used to elevate personnel for construction work. The employers who designed the platforms were not qualified and/or did not adhere to published guidelines for safe use and design of elevating platforms and rough terrain forklifts, such as ASME/ANSI B56.6, 2005 and specifically, section 8.24, items such as:  a)  A platform floor having slip resistant surface. b)  A 4 inch minimum height toe plate which may be omitted at the access opening. c) Protection for personnel in their normal working position on the platform from moving parts of the rough terrain forklift truck that present a hazard. d) A means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting.  Employees were exposed to pivoting, slippage or tipping of the platforms and forklift creating a fall hazard of approximately 20 and 35 feet.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about December 28 2016, and at times prior thereto, the subcontracted employers did not have a competent person perform daily inspections of the scaffold platforms (job made mud box and pallet), exposing employees to the hazards of falls and/or scaffold collapse/failure.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about December 28, 2016 and at times prior thereto, a wooden platform (job made mud box) and a pallet were supported by a two Sky Trak rough terrain forklifts and were used to elevate personnel for construction work. The two subcontracted employers did not consult the manufacturer on the design of the platforms and necessary changes to the forklifts operational decals. Employees were exposed to the hazards of falls up to approximately 20 and 35 feet and/or scaffold collapse/failure.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about December 28, 2016, and at times prior thereto, a wooden platform (mud box) and a pallet which were installed on two SkyTrak rough terrain forklifts and were used to elevate personnel to perform work on the apartment complex under construction. The forklifts were not designed for such use per the manufacturer's operations manuals, exposing employees to the hazards of falls of approximately 20 and 35 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  On or about December 28 2016, and at times prior thereto, a wooden platform (mud box) and a pallet which were installed on two SkyTrak rough terrain forklifts and were not securely attached to the lifts to prevent the platforms from sliding off. The platforms were used on the Sky Trak rough terrain forklifts to lift and lower the employees to perform construction work on the apartment complex under construction, exposing the employees to a fall hazard of approximately 20 and 35 feet.
