29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   (a) On July 23, 2013, at the HCA Midwest Division Facility, employees were exposed to serious caught-in, crushing and or struck-by injuries, in that the forklift operators had not completed a competent training program.             Abatement certification is required for this item;

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   (a)  On July 23, 2013, employees were exposed to point of operation from the vertical drilling machine, in that the drill bit was not covered or guarded to prevent rotating parts or flying chips/sparks from contacting the operator.
