29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4): a) For the Dakin Dairy facility at 30771 Betts Rd., Myakka City, FL 34251, as observed on or about 07/30/2013. Maintenance employees performed tasks such as, but not limited to, changing bearings, switches, drives, photo eyes, and other equipment on industrial milk filling equipment. Hazardous energy existed in the form of 110/220V electricity, 480V electricity in the electrical room, compressed air, and mechanically moving parts. No lockout tagout program was in place for any of the equipment at the establishment.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings shall be effectively closed to afford protection substantially equivalent to the wall of the equipment. a) for two circuits in the electrical cabinet at the Dakin Dairy facility at 30771 Betts Rd., Myakka City, FL 34251, as observed on or about 07/30/2013. The electrical cabinet in the electrical room had two empty, exposed breaker slots, and an open gap was present between the front face and the side of the cabinet where the front face had pulled away due to it not being secured properly.
