29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. a) On or about 7/29/13, on construction site at the City of Tonawanda H.S./Middle School, 150 Hinds St., Tonawanda, NY: Employee was exposed to a fall of 14 ft. when an extension ladder was used to access the roof of the restroom building under construction. The siderails of the ladder only extended approx. 20 inches above the roof. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder: a) On or about 7/29/13, on construction site at the City of Tonawanda H.S./Middle School, 150 Hinds St., Tonawanda, NY: Employee was exposed to a fall of 14 ft. when an extension ladder was used to access the roof of the restroom building under construction. The ladder was located near the access doorway and was subject to being displaced because the ladder was not secured. NO ABATEMENT CERTIFICATION REQUIRED
