29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: At this job site an employee entered a trench twice to perform work at the trench floor. The employee had not been adequately trained to recognize the hazards of the unprotected trench which included vertical, unprotected dirt walls and was greater than five feet in depth.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). An employee entered and worked in a trench greater than 5 feet in depth without any protection from a potential cave-in. The walls of the trench were vertical and no sloping, shoring, or shielding was used to protect the employee. Dimanondback Contractors, LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA Inspection Number 315488825, Citation Number 1, Item Number 1, and was affirmed as a final order on July 12, 2011, with respect to a workplace located at US Highway 77 Frontage Rd, Harlingen, Texas.
