(a)  On or about 07/30/13, on Lyell Road, at the housing development, under construction, in Gates, New York, employees were not provided with eye protection while using a circular saw to cut framing sections.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)   On or about 07/30/13, on Lyell Road, at the housing development, in Gates, New York. employees were setting Microllam LVL beams on the second floor, without fall protection.  Employees were working 10 feet above ground level.   The employer could not demonstrate that the use of conventional fall protection methods were infeasible or created a greater hazard.  NO ABATEMENT CERTIFICATION REQURIED

29 CFR 1926.150(a)(2): Access to all available firefighting equipment was not maintained at all times:   (a)    On or about 07/30/13, on Lyell Road, at the housing development, under construction, in Gates, New York, employees working with combustible materials, in the presence of falmmable liquids and using power tools (an ignition source), without immediate access to fire fighting equipment.  NO ABATEMENT CERTIFCATION REQUIRED
