29 CFR 1910.24(h): "Railings and handrails." Standard railings shall be provided on the open sides of all exposed stairways and stair platforms. Handrails shall be provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails shall be installed in accordance with the provisions of 1910.23.    (a) On or about August 5, 2013: On the 'John Wylie' tug, there were no guardrails in place leading from the transition-platform to the fixed stairs.  Employees were exposed to a fall hazard of at least 15 feet.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    (b) On August 5, 2013, in the plate shop the Axelson Lathe did not have guards or other devices to protect workers from the rotating chuck and flying chips.     (c) On August 5, 2013, in the plate shop Racine Hydraulic Shear Cut Horizontal Hacksaw did not have guards or other devices to protect employees from in going nip points.

29 CFR 1915.73(d): When employees are exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges shall be guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails.    (a) On or about August 5, 2013: Upon Tug boat "John Wylie - Port of St. Louis", there were no guard rails in place at the front ends of the tug.  Employees were exposed to a fall hazard of at least 15 feet.       (b) On or about August 5, 2013: There were openings located between the platform and the tug deck near the three, tool sheds, that were positioned along the side of the tug "John Wylie". The railings were too short to reach the tug deck thereby exposing employees to fall hazards of at least 15ft.      (c) On or about August 5, 2013: No guard rails were in place around the rear half of the Tug "John Wylie".  Employees were exposed to a fall hazard of at least 15 feet.

29 CFR 1910.179(j)(3): Periodic inspection. Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard:  (a) On or about August 5, 2013: Three cranes were indentified, two were operational. It was learned that complete inspections were not perforned at intervals generally defined in paragraph (j)(1)(ii).
