29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:  a) On or about August 1, 2013, two employees were working inside a trench near an unsupported section of the street concrete curb measuring approximately 10 inches wide by 12 inches tall by 4 feet long exposing them to a struck-by hazard along the southeast section of the construction site.  b) On or about August 2, 2013, an employee was working inside a trench a near the unsupported section of the street curb measuring approximately 10 inches wide by 12 inches tall and 4 feet in length exposing the employee to a struck-by hazard along the southeast section of the construction site.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    On or about August 02, 2013, an employee was exposed to a cave-in hazard while doing utility tapping work onto an 8 inch metal main water line along the bottom of a trench measuring approximately 7 feet deep by 7 feet wide by 16 feet long. The spoil pile was closer than two feet from the edge of the trench along the southeast section of the construction site.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  On or about August 02, 2013, an employee was working inside a trench measuring approximately 7 feet deep by 7 feet wide by 16 feet long that did not have an adequate protection system exposing the employee to hazardous conditions such as, but not limited to, a lack of protective systems, the spoil pile located near the trench and an unsupported structure on the top open edge of the face wall of the trench located along the southeast section of the construction site.
