The employees were observed using pneumatic nailers to repair a residential roof.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On 7/29/2013, an employee from Midwest Roofing and Construction was not wearing fall protection while repairing a residential roof on a home located on Gingerwood Circle, St. Peters, MO. He was observed on the roof of the building wearing a harness, but the harness was not tied off or connected to a anchoring point with a rope.
