OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to isocyanate, which was causing or likely to cause respiratory illness such as asthma or skin sensitization.     a.  On or about August 13, 2013, an operator working in the lamination process area was exposed to toluene-2,6-diisocyanate (TDI).  Exposures occurred via inhalation at concentrations of 0.08 milligrams per cubic meter.

29 CFR 1910.134(a)(2): The employer did not establish and maintain a respiratory protection program which included the requirements outlined in 29 CFR 1910.134(c):   Employees in the warehouse area, performing lamination process using polyurethane foam, thermoplastic polyurethane, and syntethic material were exposed to chemical hazards such as but not limited to those associated with toluene diisocyanate and hexamethylene diisocyanate.  Respiratory protection and a respirator program was not developed and implemented for this facility.

29 CFR 1910.1000(a): 29 CFR 1910.1000(a):  The employer did not ensure that no employee was exposed to any substance at a level in excess of the exposure limit given for that substance in Table Z-1 of this standard.  On or about August 13, 2013, an operator working in the lamination process area was exposed to toluene-2,4-diisocyanate(TDI).  Exposures occurred via inhalation at an average concentration of 0.32 milligrams per cubic meter.  This concentration was 2.25 times the permissible ceiling limit of 0.14 milligrams per cubic meter.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):  On or about August 13, 2013, an operator working in the lamination process area was exposed to toluene-2,4-diisocyanate(TDI).  Exposures occurred via inhalation at an average concentration of 0.32 milligrams per cubic meter.  This concentration was 2.25 times the permissible ceiling limit of 0.14 milligrams per cubic meter.  Engineering controls did not effectively reduce employee exposure to required limits.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area:    Employees at this worksite working with polyurethane foam, thermoplastic Polyurethane, and DUREFLEXX PT5000S NAT, Flexible Slab Laminated Foam were not trained in the chemical hazard released by these products when heated during the lamination process at this site. Chemicals hazards such as but not limited to those caused by hydrogen cyanide, 2,4-toluene diisocyanate, hexamethylene diisocyanate and 2,6-toluene diisocyanate.
