29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about 07/30/13, at the warehouse area, at Sea Chest/ACE Hardware, St. Thomas, VI. The employer did not develop a written hazard communication program to ensure having material safety data sheets as follows: a. Employees used and/or handled compressed gases such as propane (LPG) when replacing empty tanks with full ones during Caterpillar forklift maintenance operations. b. Employees used and/or handled gasoline fuel when re-fueling tank during Toyota forklift maintenance operations. NOTE: Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).

The employer did not have a material safety data sheet for each hazardous chemical used and/or handled as follows: a. Employees used and/or handled compressed gases such as propane (LPG) when replacing empty tanks with full ones during Caterpillar forklift maintenance operations. b. Employees used and/or handled gasoline fuel when re-fueling tank during Toyota forklift maintenance operations. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer within 24 hours of the inspection.
