29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: The employer does not ensure that newly hired employees , whose noise exposure levels equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels, were included in a continuing, effective hearing conservation program. This violation was discovered on or about July 31, 2013, in the Planer Department where an employee operating a stacker was exposed to high noise levels that can potentially result in hearing loss. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees exposed to noise levels of 85 decibels or greater measured as an 8- hour time- weighted average are included in a continuing and effective hearing conservation program.
