29 CFR 1910.1001(j)(2): Installed Asbestos Containing Material. Employers and building owners are required to treat installed TSI and sprayed on and troweled-on surfacing materials as ACM in buildings constructed no later than 1980 for purposes of this standard. These materials are designated "presumed ACM or PACM", and are defined in paragraph (b) of this section. Asphalt and vinyl flooring material installed no later than 1980 also must be treated as asbestos-containing. The employer or building owner may demonstrate that PACM and flooring material do not contain asbestos by complying with paragraph (j)(8)(iii) of this section.     a. On or about August 8, 2013, at the above addressed jobsite, an employee was conducting Class II asbestos work, removal of asbestos vinyl and associated mastic. The employer did not treat material such as vinyl flooring and pipe covers as being asbestos-containing, thereby exposing the employee to the hazards associated with asbestos.

29 CFR 1926.1101(g)(8)(i): For removing vinyl and asphalt flooring materials which contain ACM or for which in buildings constructed no later than 1980, the employer has not verified the absence of ACM pursuant to paragraph (g)(8)(i)(I) of this section. The employer did not ensure that employees comply with the work practices listed in paragraphs (A) through (I) of this section:    a. On or about August 8, 2013, at the above addressed jobsite, an employee was conducting Class II asbestos work, removal of asbestos vinyl and associated mastic.  The employer failed to ensure the following:       1. Vacuums equipped with HEPA filter, disposable dust bag, and metal floor tool (no brush) shall be used to clean floors.   2. Resilient sheeting shall be removed by cutting with wetting of the snip point and wetting during delamination.  Rip-up of resilient sheet floor material is prohibited.   3. All scraping of residual adhesive and/or backing shall be performed using wet methods.   4. Dry sweeping is prohibited.   5. Mechanical chipping is prohibited unless performed in a negative pressure enclosure which meets the requirements of paragraph (g)(5)(i) of this section.   6. Tiles shall be removed intact, unless the employer demonstrates that intact removal is not possible.

29 CFR 1910.1001(k)(2): All spills and sudden releases of material containing asbestos shall be cleaned up as soon as possible.    a.  On or about August 8, 2013, at the above addressed jobsite, an employee was entering into a mechanical room which contained damaged asbestos materials and accompanying dust.  The employer failed to clean up as soon as possible ACM waste and debris, thereby exposing an employee to the hazards associated with asbestos.

29 CFR 1926.1101(k)(9)(iv)(A): For work with asbestos containing roofing materials, flooring materials, siding materials, ceiling tiles, or transite panels, training shall include at a minimum all the elements included in paragraph (k)(9)(viii) of this section and in addition, the specific work practices and engineering controls set forth in paragraph (g) of this section which specifically relate to that category. Such course shall include "hands-on" training and shall take at least 8 hours.    a. On or about August 8, 2013, at the above addressed jobsite, an employee was conducting Class II asbestos work, removal of asbestos vinyl flooring and associated mastic.  The employer did not institute a training program, thereby exposing the employee to the hazards associated with asbestos.
