29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:   (a)  On or about 8/9/13 - Blue Creek Lumber mill areas, employees are assigned to work in areas such as the head saw and edger positions and are exposed to noise levels exceeding 85dBA:   On or about 8/19/13 - The Off Bearer (headsaw) position was exposed to continuous noise at 145 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent level of 99.3 dBA.  The sampling was performed for 193 minutes during one shift.   On or about 8/19/13 - The edger position was exposed to continuous noise at 65.2% of the allowable 8-hour time-weighted average sound level of 85dBA or an equivalent level of 93.9 dBA.  The sampling was performed for 183 minutes during one shift.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)  On or about August 9, 2013 - Blue Creek Lumber, a hazard communication program had not been developed for employees exposed to lubricants, fuels and wood dust.  The Blue Creek Lumber, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.1200(e)(1)), which was contained in OSHA inspection number 762302, citation number 2, item number 3 and was affirmed as a final order on April 22, 2013, with respect to a workplace located at 255 Blue Creek Road, Vina, AL  35593.
