29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    The employer failed to protect employees from potential fall hazards associated with re-roofing an existing residential home with a roof height over 10 ground to eve.  The most recent example of this was found on the job site located at 2904 Courtney Dr.  Bellevue, NE 68133 where the employer had employees re-roofing an existing residential home with ground eave heights over 10 and roof pitch greater than 4-12 without any form of fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   The employer failed to meet the requirements of this paragraph of the subpart in that they are failing to ensure that employees are using a ladder in accordance with the standards outlined in the regulation.  The most recent example of this was found on the job site located at 2904 Courtney Dr.  Bellevue, NE 68133 where the employer has employees re-roofing an existing residential home with ground eave heights over 10 and roof pitch greater than 4-12; using an extension ladder as a means of access and the ladder does not extend the minimum 3 above the walking/working surface.  Instances include but are not limited to:  i.    Werner aluminum extension ladder from the ground to the roof above the garage.  ii.   Werner aluminum extension ladder (bottom portion only) straddling the peak of the garage and used to access the highest point of roof of the house.

The most recent example of this was found on the job site located at 2904 Courtney Dr.  Bellevue, NE 68133 where the employer has employees re-roofing an existing residential home with ground eave heights over 10 and roof pitch greater than 4-12; using an extension ladder set up at an angle of 1:.7 instead of the required 4:1 ratio.
