29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program, as described in 29 CFR 1910.95 (c) through (n) was not instituted, when employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels:   Divine Printing, Inc/Metuchen, NJ site - Production Area: The employer did not provide a continuing effective Hearing Conservation Program for employees exposed to noise levels above 85 dBA. Employees working in the production area were exposed to continuous noise levels of 87.6 dBA (packer on machine #4),  87.4 dBA (operator of machine #2) for an 8-hour TWA,  which is equivalent to doses of  72.25%, and 70.29% respectively.  These levels exceeded OSHA Action Level of 85 dBA. Sampling time was 450 minutes, and 458 minutes respectively.  Zero exposures were assumed for all unsampled time periods.  Condition observed on or about August 13, 2013.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented when respirators were necessary to protect the health of the employee:  Divine Printing, Inc./Metuchen, NJ site - Production Area: The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the users voluntarily wearing half face MSA respirators.
