OSH ACT of 1970 Section (5) (a) (1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees using powered industrial trucks with a roll clamp attachment to lift 8000 - 8600 lb. rolls with handling pads clamped at the bottom of the rolls: a) During the period of March 26, 2013 and July 26, 2013, employees were required to work with and around powered industrial trucks (forklifts) equipped with Cascade paper roll clamps. The employer had not performed regular roll clamps drift test to prevent rotational drift. Employees were thereby exposed to the hazards associated with falling loads and over turned powered industrial trucks. One feasible and acceptable abatement method to correct this hazard is to have qualified personnel perform a rotation creep test as required by the original equipment manufacturer to: 1) verify the roll clamp does not have rotational drift due to worn hydraulic components 2) verify with the truck manufacturer that the lift practices are approved, after providing such data as clamp model and weight, horizontal and vertical centers of gravity, roll weight height and diameter, and location of pads on the roll.

29 CFR 1910.178(a)(5): For a truck equipped with front-end attachments other than factory installed attachments, the user did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and the attachment combination at maximum elevation with load laterally centered: a) On or about August 15, 2013, employees were required to use a powered industrial vehicle (Hyster rental truck model number S155XL2 - Serial number C024V02136C) to lift approximately 8500 pound paper rolls with a Cascade paper clamp (model number 120F-RCS) without the used requesting that the truck be marked to identify the attachments and show the approximate weight of the truck and the attachment combination at maximum elevation with load laterally centered.
