Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On 8/05/2013, employees from Dynamic Construction were working on a roof of a residential building located at 10 Kingston Court, St. Peters MO. Employees and the crew leader, Antonio Recmeo, were working on the roof of the residence, which was approximately 8 feet above the ground, without the use of guardrail systems, safety net systems, or personal fall arrest systems.

On 8/05/2013, employees from Dynamic Construction were working on a roof of a residential building located at 10 Kingston Court, St. Peters MO. Employees were using a ladder to access a roof, which was approximately 12 feet above the ground. The defective or damaged portable ladder, no serial number, had damaged or bent rungs and a broken extension catch.
