29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 8/14/13, in the new stair tower of an old two story factory building being converted into apartments at 320 Grote St., Buffalo, NY: A portable drill was used to drill holes through a wall. 120 volt-ac power was supplied to the drill via an extension cord which was plugged into a wall receptacle on the first floor. The plug on the extension cord lacked a grounding prong. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 8/15/13, in the New Stair Tower area, of an old two story factory building being converted into apartments at 320 Grote St., Buffalo, NY: Employees of E.B. Atlas Steel Corp. and of other employers were exposed to a fall of approx. 14 ft. from the second story metal decked canopy. This area was accessible from the second story hallway. No guardrails or other fall protection system was being utilized to protect employees. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) On or about 8/15/13, in the New Stair Tower area, of an old two story factory building being converted into apartments at 320 Grote St., Buffalo, NY: Employees of E.B. Atlas Steel Corp. were engaged in building a masonry wall while working from a 2-plank wide "bracket" attached to the 4th level of a masonry scaffold. The employees were exposed to a fall of approx. 22 ft. to the concrete floor from the east end of the 2 planks. No Guardrails were installed. b) On or about 8/15/13, in the New Stair Tower area, of an old two story factory building being converted into apartments at 320 Grote St., Buffalo, NY: Employees of E.B. Atlas Steel Corp. and of other employers were exposed to a fall of approx. 14 ft. from the 4 plank wide second level of a masonry scaffold that was flush with the metal decked canopy. This area was accessible from the second story hallway. No guardrails or other fall protection system was being utilized to protect employees. NO ABATEMENT CERTIFICATION REQUIRED
