29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:   a) On or about 5/23/16, at the Delta Sonic Car Wash, 1264 Main Street, Buffalo, NY: An employee using a large wrench to fasten components of a steel support structure  was exposed to a fall of 12 ft. while sitting on the top of a 12 ft. fiberglass stepladder, straddling the ladder, with his left foot on a step the climbing side of the ladder and his right foot on a cross member on the backside of the ladder.  b) On or about 5/23/16, at the Delta Sonic Car Wash, 1264 Main Street, Buffalo, NY: An employee using a large wrench to fasten components of a steel support structure was exposed to a fall of 9 ft. while standing on the top step (ie., the first step below the top) of a 10 ft. fiberglass stepladder.    NO ABATEMENT CERTIFICATION REQUIRED
