29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) 228 Arch Street - Employees cleaning brick from a tubular welded frame scaffold were exposed to a fall hazard of approximately thirty-nine (39) feet without the use of a personal fall arrest system or guardrail system.  Observed on or about August 14, 2013.  QQ Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 315816462, citation number 01, item number 004(a) and was affirmed as a final order on 02/15/2012, with respect to a workplace located at 2301 S 7th Street, Philadelphia, PA, 19148.  QQ Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 314235193, citation number 01, item number 001(d) and was affirmed as a final order on 10/26/2012, with respect to a workplace located at 7th and Federal Street, Philadelphia, PA, 19147.

29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used.   a) 228 Arch Street - Employees were not provided with a safe means of access and/or egress to the tubular welded frame scaffold platform, thus exposed to a fall hazard of approximately thirty-nine (39) feet.  Employees were using the side frame of the scaffold to access and/or egress from the working levels.  Observed on or about August 14, 2013.  QQ Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(e)(1), which was contained in OSHA inspection number 315816462, citation number 01, item number 002 and was affirmed as a final order on 02/15/2012, with respect to a workplace located at 2301 S 7th Street, Philadelphia, PA, 19148.
