29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 1 August 2013, two employees were installing plywood on the third level of the building under construction without the use of fall protection, exposing employees to a fall hazard of up to approximately 26 feet to the unfinished concrete foundation below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. On or about 1 August, 2013, two employees were working without fall protection on the edge of the third floor up to approximately 26 feet high without the employer providing fall protection training, exposing the employee to a fall hazard.

On or about 1 August 2013, An employee was using a six foot portable, free-standing ladder to install plywood on the third floor of the building under construction. The employee had one foot on the ladder and the other foot on the framework, exposing the employee to a fall hazard.
