29 CFR 1926.62(d)(3)(iii): Where the employer had previously monitored for lead exposures, and the data was not obtained within the previous 12 months during work operations conducted under workplace conditions closely resembling the processes, type of material, control methods, work practices, and environmental conditions used and prevailing in the employer's current operations, the employer relied on the earlier monitoring results: a. Route 22 Bridge over Route 309 in Pennsylvania - The employer relied upon 2008 sampling data indicating employees were not overexposed to inorganic lead while performing gunning and grinding operations on steel girders when personal monitoring conducted conducted on September 3, 2013 identified employees overexposed to inorganic lead between 200 micrograms / cubic meter of air and 220 micrograms / cubic meter of air as an eight hour time weighted average, 4 to 4.45 times the OSHA Permissible Exposure Limit (PEL).

29 CFR 1926.62(j)(1)(ii): The employer did not institute a medical surveillance program in accordance with 29 CFR 1926.62(j)(2) and (j)(3) for all employees who were or may have been exposed by the employer at or above the action level for more than 30 days in any consecutive 12 months a. Route 22 Bridge over Route 309 in Pennsylvania - Employees while using needle guns and grinders to remove lead from the structural beams of the bridge were exposed to inorganic lead above the action level and the employer did not institute a medical surveillance program for employes, on or about September 3, 2013.
