29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: On or about August 21 2013, a commercial structure was under construction without the employer ensuring that frequent and regular inspections of the job site were conducted by a competent person; exposing employees to the hazards associated with their work, in this case working on the roof of the structure without fall protection.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. On or about August 21 2013, an employee was observing on-going work on the roof of a commercial structure up to approximately sixteen (16) feet high without fall protection, exposing the employee to a fall hazard.
