29 CFR 1926.350(a)(9): Compressed gas cylinders were not secured in an upright position at all times: a) East Side of the Site, 1st Floor - An oxygen cylinder was observed stored at a 45 degree angle leaning against a steel I-beam exposing him to a potential struck by and fire hazard, on or about 08/21/13. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.350(a)(10): Oxygen cylinders in storage were not separated from fuel-gas cylinder or combustible materials (especially oil or grease), a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour): a) East Side of the Site, 1st Floor - A superintendent was observed near an oxygen and acetylene cylinders which were not in use and stored together exposing him to a potential struck by and fire hazard, on or about 08/21/13. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) West Side of the Site, 1st Floor - Carpenters were observed without fall protection working on the deck exposing them to an 11 foot fall hazard, on or about 08/21/13. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent stated he conducts daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, this contractor is being cited under OSHAs Multi-Employer Workplace Policy. The Hamel Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 316182641, citation number 2, item number 1 and was affirmed as a final order on 05/02/2012, with respect to a workplace located at 3506 Georgia Ave, NW, Washington DC 20009.
