29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Grinding/cutting area- The employer failed to implement a hearing conservation program for an employee grinding and cutting flanges off of fiberglass tubs and showers. The employee was exposed to continuous noise at 132% of the permissible daily exposure of 85 bBA (8-hour time weighted average) or an equivalent sound level of 98.5 dBA, which exceeded the action limit of 85 dBA. Results were from a 378 minute sampling period conducted on August 29, 2013. Spurlin Industries Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 601958, citation number 1, item number 1 and was affirmed as a final order on January 29, 2013 with respect to a workplace located at 625 Main Street, Palmetto, Georgia.
