29 CFR 1926.502(d)(16)(iii): Fall arrest systems were not rigged such that an employee could neither free fall more than 6 feet (1.8 m), nor contact any lower level:     a) Jobsite, 524 North Homewood Avenue, Pittsburgh, PA: On or about September 6, 2013, during pre-cast concrete installation activities along the 2nd story floor of the building under construction, the employer did not ensure that personal fall arrest systems were correctly set up and used. An employees was tied off to an anchor point that was secured within a few feet from the outer edge of the pre-cast decking area he was working on, and he worked approximately 20 feet away along  the edge of the pre-cast deck, enabling him to be able to fall more than 6 feet and be able to contact the ground below him, a distance that was determined to be approximately 15 feet.

29 CFR 1926.501(b)(12):  Each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:     a) Jobsite, 524 North Homewood Avenue, Pittsburgh, PA: On or about August 27, 2013, during pre-cast concrete installation activities, the employer did not ensure that appropriate fall protection systems or devices were used where employees were exposed to fall hazards of up to approximately 8 feet, 8 inches.        Patterson Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(12), which was contained in OSHA inspection number 314109018, citation number 2, item number 1, and was affirmed as a final order on July 28. 2010, with respect to a workplace located at 2401 Smallman Street, Pittsburgh, PA.       Patterson Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(12), which was contained in OSHA inspection number 312636491, citation number 1, item number 1, and was affirmed as a final order on January 11, 2010, with respect to a workplace located at 5100 Campbells Run Road, Pittsburgh, PA.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use did  not present a health hazard to the user:    a) Jobsite, 524 North Homewood Avenue, Pittsburgh, PA: On or about September 6, 2013, during pre-cast concrete installation activities, the employer did not ensure that an employee who voluntarily wore a respirator during concrete saw cutting operations was provided with a medical exam.
