29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): (a) Jobsite: On or about August 22, 2013, two employees were working next to an excavated sidewall that was over 20 feet in height and the sidewall was not sloped nor was there a protective system in place. In addition, the company did not have a registered professional engineer's design in writing for either the protective system or the sloping system that was to be used to protect the employees from a sidewall cave-in.
