29 CFR 1926.651(j)(2):   Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a)  Spartan Avenue & Littleton Road, Parsippany, NJ.  Employees were exposed to struck-by injuries in the 7 foot, 3 inch deep section of the excavation as the employer had not ensured that soil which could fall into the excavaton was kept back at least 2 feet from the edges of the excavation.                                                           Violation observed on or about 09/06/2012.

29 CFR 1926.651(k)(2):   Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a)  Spartan Avenue & Littleton Road, Parsippany, NJ.  Employees were exposed to crushing injuries from a possible cave-in as the competent person who had evaluated the excavation conditions prior to work allowed employees to enter the up to 7 foot, 3 inch deep excavation without the necessary protective systems in place.                                                       Violation observed on or about 08/29/2013.

29 CFR 1926.652(a)(1):   Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).  The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):    a)  Spartan Avenue & Littleton Road, Parsippany, NJ.      Employees placing the concrete wing wall in the excavation were exposed to struck-by and crushing injuries from a cave-in, in the up to 7 foot, 3 inch deep excavation which was not adequately sloped or protected by shields or shoring.
