29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:      a) On or about Tuesday, August 27, 2013, three employees were working in an excavation that was not properly protected from cave-in hazards in type C soil. The 8 x 12 ft. trench box was not installed in a manner to prevent lateral movement. The box was not abutted against the excavation walls; there was a void between the side of the box and the excavation walls. The top of the box did not extend above the east wall and the south end was not shielded. Employees were working outside of the trench box at the north end of the excavation and in close proximity to excavation walls not sloped properly for type C soil. No ladder or other safe means of egress were utilized for employees entering and/or exiting the excavation. The spoil pile was not set back at least 2 ft. from the edge of the excavation on the east wall. The depth of excavation was approximately 8 feet 6 inches to the bottom.       Abatement Certification and Abatement Documentation Required.     PTS Contractors, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or an equivalent Standard which was contained in OSHA Inspection Number 312559297, Citation No. 1, Item No. 3b, issued on 4/08/2011, and affirmed as a Final Order on 4/29/11, with respect to a workplace located on the corner of County Rd C and Persnickity Pl., Plymouth, Wisconsin 53073.
