29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii). The employer does not fully plank each platform on all working levels of scaffold. This violation was observed on or about August 26, 2013, at the construction site where employees were exposed to a 19 foot 6 inch fall hazard when performing stucco work from a scaffold without the scaffold being fully planked. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all working levels of scaffold are fully planked.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews. The employer does not provide guardrails along all open sides and ends of scaffold platforms. This violation was observed on or about August 26, 2013, on a scaffold at the job site where employees were exposed to a 19 foot 6 inch fall hazard when performing stucco work from a scaffold without a guardrail system along all open sides and ends. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when working from scaffolds.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. The employer does not provide access ladders or other means for accessing scaffold platforms. This violation was observed on or about August 26, 2013, on the job site where employees were exposed to a 19 foot 6 inch fall hazard while ascending and descending the frame of the scaffold without a ladder or other means to accessing the scaffold platform. Martinez Plastering was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 C.F.R. 1926.451(e)(1), which was contained in OSHA inspection number 315630442, citation number 1, item number 1a and was affirmed as a final order on March 07, 2012, with respect to a workplace located at 14101 North IH-35, Austin, TX 78753. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when accessing platforms on scaffolds.
