29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates, mud sills or other adequate firm foundation:  On or about June 26, 2017, an employee was directed to apply stucco to the residential home remodel on a four leveled tubular welded scaffold up to approximately 30 feet high when it collapsed, exposing employees to the hazard of falls. The employer did not ensure that the scaffold had base plates and mud sills or other adequate firm foundation.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less therafter for scaffolds greater than 3 feet (0.91m) wide:  On or about June 26, 2017, an employee was directed to apply stucco to the residential home remodel on a four leveled tubular welded scaffold up to approximately 30 feet high when it collapsed, exposing employees to the hazard of falls. The employer did not ensure the scaffold was tied in to prevent tipping.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about June 26, 2017, employees were directed to apply stucco to the residential home remodel on a four leveled tubular welded scaffold up to approximately 30 feet high when it collapsed, exposing employees to the hazard of falls. The employer did not ensure the scaffold was inspected by a competent person before work started.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about June 26, 2017, and at times prior thereto, employees were applying stucco to the residential home remodel from a four leveled tubular welded scaffold that did not have a ladder for access, exposing employees to a fall hazard.  The Martinez Plastering company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 938009, citation number 2, item number 1 and was affirmed as a final order on 10/29/2013, with respect to a workplace located at 3995 State Hwy 6, College Station, TX 77845.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  On or about June 26, 2017, and at times prior thereto, employees were applying stucco to the residential home remodel on a four leveled tubular welded scaffold that did not include guard rails, exposing employees to a fall hazard.  The Martinez Plastering company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(4)(i), which was contained in OSHA inspection number 938009, citation number 1, item number 2 and was affirmed as a final order on 10/29/2013, with respect to a workplace located at 3995 State Hwy 6, College Station, TX 77845.
