OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall and entrapment hazard without a means to be rescued. A) Field area, on or about September 3, 2013, employees enter into railcar(s) to walk the grain down in the middle, while grain remains on the sides exposing employees to an engulfment hazard and a fall hazard of greater than 5 feet, with employee not being attached to a retrieval system.
