OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees wee exposed to a fall hazard: A) Warehouses 5 and 6, on or about 11/19/14, the design of the personal fall arrest system (safety harness and lanyard) used by the employees working on top of bags stacked approximately 11 feet high would not prevent the employee from striking the floor below if they fell from the top of the bags. One feasible abatement method is to have a qualified person design a fall protection system that will prevent employees from striking the floor or lower level if they fell while working on top of the bags.

Liberty Terminals, LLC, was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1917.111(d) which was contained in OSHA inspection number 419384 citation number (1), item number (4), and was affirmed on October 29, 2012, through an informal settlement agreement, with respect to a workplace located at 112 Marine Terminal Dr., Savannah, GA.
